§ 1 Scope

These terms apply to all contracts for site analyses and reports of PLAIC GmbH i.G. (“PLAIC”) with customers who are businesses within the meaning of § 14 German Civil Code. Conflicting terms of the customer do not apply.

§ 2 Subject of the service

Based on the site data provided by the customer and on public and proprietary data sources, PLAIC automatically produces an analysis report (PDF) on the suitability of a site for charging infrastructure. The report contains calculations, model assumptions and estimates. In particular, grid capacity is a heuristic estimate and does not replace information from the grid operator; only a grid connection enquiry is binding.

§ 3 Conclusion of contract

The request via the form (order PDF) is an offer by the customer. The contract is concluded when PLAIC confirms the order in text form or starts performing it.

§ 4 Prices and payment

The prices published at the time of ordering apply, plus statutory VAT. Invoices are payable within [14] days without deduction. The analysis is carried out once payment has been received [adjust if needed].

§ 5 Delivery

Delivery is by PDF via email. Processing times are non-binding guide values and may depend on the availability of external data sources.

§ 6 Customer cooperation

The customer is responsible for the accuracy and completeness of the data provided. Results are only as reliable as the underlying data.

§ 7 Rights of use

The customer receives a simple, non-transferable right to use the report for its own business purposes, internally and towards project participants. Passing it on to third parties as a product of their own is excluded. [review]

§ 8 Liability

PLAIC is liable without limitation for intent and gross negligence, for injury to life, body and health, and under the Product Liability Act. For slight negligence PLAIC is liable only for breach of essential contractual obligations and limited to the foreseeable damage typical for the contract. PLAIC gives no guarantee of economic success for investment or planning decisions taken on the basis of the report. [have limitation reviewed legally]

§ 9 Privacy

The privacy policy applies.

§ 10 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction, where permissible, is [city]. Should individual provisions be invalid, the remaining provisions remain unaffected.
